We are not obligated to honour a price that was mistakenly listed due to a typographical, technical, or pricing error.

5. Orders, Payments & Order Acceptance

5.1 Placing an order on the Website constitutes an offer by you to purchase the selected product(s), which is subject to acceptance by us. We reserve the right to accept or decline any order at our sole discretion, including in cases of suspected fraud, incorrect pricing, unavailability of stock, or errors in the product or pricing information.

5.2 An order is considered confirmed only once you receive an order confirmation via email, SMS, or WhatsApp. A confirmation does not guarantee product availability.

5.3 We accept payments through the payment methods listed on the Website, including debit/credit cards, UPI, net banking, digital wallets, and Cash on Delivery (where available). All online payments are processed through secure, PCI-DSS compliant third-party payment gateways. We do not store your card or banking credentials on our servers.

5.4 In the event a payment is deducted from your account but the order is not confirmed, please contact us at business@wellza.in with your transaction details, and we will assist in resolving the issue or initiating a refund in accordance with our Refund Policy.

6. Shipping & Delivery

6.1 We aim to process and ship orders within the timeframe specified on the Website or at the time of order confirmation. Delivery timelines are estimates only and are not guaranteed, as they may be affected by courier delays, logistical constraints, weather conditions, or events beyond our reasonable control.

6.2 Shipping charges, if applicable, will be displayed at checkout prior to order confirmation.

6.3 Risk of loss and title to the products pass to you upon delivery to the shipping address provided at the time of order. It is your responsibility to ensure that the delivery address and contact information provided are accurate and complete.

6.4 We are not responsible for delays or non-delivery caused by an incorrect or incomplete address provided by you, or your unavailability to receive the shipment.

7. Cancellations, Returns & Refunds

7.1 Order cancellation requests may be accepted only before the order has been shipped. Once dispatched, orders cannot be cancelled.

7.2 Given the nature of our products (consumable, health, and personal-care items), returns are accepted only in cases of a damaged, defective, expired, or incorrect product received, and must be reported within 7 days of delivery along with photographic/video proof, in accordance with our Refund & Return Policy.

7.3 For hygiene and safety reasons, products that have been opened, used, or tampered with are not eligible for return or exchange, except where the product itself is proven defective.

7.4 Approved refunds will be processed to the original mode of payment within 5-7 business days, or as store credit, at our discretion, in line with applicable consumer protection regulations.

8. Intellectual Property Rights

8.1 All content on this Website, including but not limited to the Wellza name, logo, trademarks, product formulations, graphics, text, images, videos, website design, and layout (“Content”), is the property of Softbiz Solutions Private Limited or its licensors and is protected under applicable Indian and international intellectual property laws.

8.2 You may not reproduce, distribute, modify, publicly display, republish, download, or create derivative works from any Content without our prior written consent.

8.3 Any unauthorised use of the Content may result in civil and/or criminal liability under applicable law.

9. User-Generated Content & Reviews

9.1 If you submit reviews, ratings, comments, images, or other content (“User Content”) on the Website, you grant Wellza a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, modify, and display such User Content for promotional and business purposes.

16. Governing Law & Dispute Resolution

16.1 These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

16.2 Subject to Clause 16.3, any disputes arising out of or in connection with these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the courts at Gurgaon, Haryana, India.

16.3 We encourage users to first reach out to our support team at business@wellza.in to resolve any grievance amicably before initiating any formal dispute resolution or legal proceedings.
